Description

A Constitution is of perpetual utility. The Supreme Court of USA – in the Cohens V. Verginia (1821) case - says that ‘a Constitution is an immortal one. It adds that the supreme and irresistible power to make or unmake a Constitution resides only in the whole body of the people, and not in any subdivision of them.’ If there is anything repugnant in a Constitution, the judges are free to follow the law instead of the Constitution.A Constitution regulates the motive of private interest and is not an impediment for taking any legally valid action. It must be considered as a whole and no part of it is superior to any other part.It contains a provision to repeal it. This provision cannot be used to repeal the same provision so long as a nation does not undergo any disintegration. When it is used, it is like setting fire to it. The Constitution no longer exists.A Constitution is an act of will and of artifice. It is the will of the people to enforce rule of law and it traps those doing violence to it.As the people have no liberty to know such points, the USA amended its Constitution more than twenty five times, India more than one hundred times and Russia amended its Constitution to make Mr. Vladimir Putin, the President of Russia until 2036.Thus, the people are in a world without liberty. This book deals with the day-to-day politics of India for the period from 15 June 2020 to 14 August 2020 in the light of the Constitution of India and the Supreme Court of India. The Chapter 1 corresponds to the Letter No. 839 and the Chapter 23 to Letter No 861.
